UPON Counsel for the Defendant and the Interested Party informing the Court and the Claimant per its advocate that:
(i) the New Planning Application referred to in the Court Order dated 13 October 2021 was submitted by the Interested Party to the Defendant and duly approved by the Defendant ref 21/01289/B (“the New Approval”) on 21 July 2022; and
(ii) the Interested Party and the Defendant have concluded an agreement pursuant to section 13 of the Town and Country Planning Act 1999 pursuant to the New Approval whereby inter alia the Interested Party undertook not to implement planning approval PA 20/01215B or any tree removal works incidental thereto (PA 20/01215B being the decision the subject of these proceedings before the Court)
And it appearing to the Court that all the Parties wish to conclude the proceedings before the Court on the terms set out herein IT IS - by consent of the parties - ORDERED that the proceedings be and hereby are dismissed with no order as to costs.
