The application site represents the curtilage of 5 Hailwood Court in Douglas. This first floor apartment is located off Johnny Wattersons Lane and Hailwood Avenue within the built up residential area of Governors Hill, adjacent to the "Cat with no Tail" public house and Alice in Wonderland Kindergarten.
The proposed planning application is seeking approval for the conversion of this first floor residential apartment into a holistic therapy business.
The application site is within an area of "Residential Use" under the Douglas North Local Plan, which was adopted by Tynwald in 1998. The following policies within the adopted Isle of Man Strategic Plan 2007 are considered relevant - General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Housing Policy 18 states: "Applications which would involve the loss of existing housing which is fit for habitation or which could be made fit at reasonable cost will not usually be approved unless accompanied by firm proposals for replacement housing".
Community Policy 2 states: "New community facilities should be located to serve the local population and be accessible to noncar users, and should where possible re-use existing vacant or underused buildings".
There are no previous planning applications to be considered in the assessment and determination of this application.
Douglas Corporation has no objection with the proposed development. The Department of Transport Highways Division do not oppose - has no traffic management, parking or road safety implications. Note: Parking is available in the current car park which serves the other commercial properties in this area.
The land use zoning for this area of Douglas is designated as Residential and the proposed change of use would be contrary to this use. But it is judged that as the site is surrounded by various retail outlets (public house, shop, betting shop, pharmacy etc); the principle for change of use would be compatible with its surrounding uses and is considered acceptable in this instance.
This is a result of a visit to the site, as it is clear that Hailwood Court is an area of mixed use. The acceptability of the provision of retailing or commercial use in this close vicinity has already been examined and accepted at numerous properties within Hailwood Court. There are parallels between
previous planning applications and the current one, which leads to the conclusion that this current application is acceptable. It is judged that the loss of housing would not have an undue effect on the locality given the existing uses of Hailwood Court it is considered that such effect would not outweigh the fact that planning approval has already been granted, and implemented, for other similar developments. As such, it is considered that the siting of the proposed therapy room within this area of Governors Hill would be in-keeping with the character of the locality, as the proposed use would appear to be appropriate in this location and would not be detrimental to the amenities of Douglas town centre.
The only external alterations proposed would be a sign (removable lettering) for the inside of the window, which would not have an adverse impact on the appearance of the property or locality.
It is judged that the projected vehicles to be associated with the proposed development would not have a detrimental impact on the existing car parking provision in the locality. This is supported by the comments from the Highway Divisions, that the proposal would not result in any traffic management, parking or road safety implications. This new community facility is located as to be easily accessible by the local population and non-car users.
As such, the proposed use accords with the relevant planning policies contained within the Isle of Man Strategic Plan 2007 and it is recommended that the planning application should be approved.
It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

C 3. The premises hereby permitted shall only operate between 09:00 hours and 21:00 hours on Mondays to Saturdays.
