Planning Status And Relevant Policies
Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Environment Policy 35, paragraph 8.12.1.
Assessment
The application site is located within a Conservation Area. The proposal is to erect a replacement garage/workshop. The applicant has clarified that the workshop is a private workshop to replace the existing non-commercial workshop. The use of the workshop can be conditioned to ensure it is ancillary to the main dwellinghouse of No.5 Windsor Terrace.
The Conservation Officer is content with the proposal. This existing garage does not contribute to the character and appearance of the Conservation Area. The proposal cannot realistically preserve or enhance the character and appearance of the Conservation Area; however, when judged against what it is replacing the proposal would have a neutral effect on the character and appearance of the Conservation Area.
On balance, it is judged that the proposal is acceptable and would not adversely affect the visual amenities of the locality.
Recommendation
It is recommended that planning permission be granted subject to conditions in the attached schedule.
PARTY STATUS
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the erection of a replacement garage and combined workshop as shown in drawing number 0638/PL01 Rev.B and garage door detail date stamped 27th April 2010.
C 3.
The garage/workshop shall only be used for ancillary purposes to the enjoyment of the main dwellinghouse of No.5 Winsdor Terrace. I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
