The application site forms the curtilage of the Tynwald Restaurant, Main Road, St Johns. The property is a two storey building, located on the corner of Station Road and Peel Road and to the immediate south of Tynwald Hill.
The application site is located within an area zoned as an "Area of Retail" in the St Johns Local Plan (Planning Circular 6/99).
Planning application 07/01232/B sought permission for the construction of a conservatory and a new entrance. Also proposed was an external staircase to the Station Road elevation and a single door to replace the double door to the front elevation. In addition, a flat roof extension was proposed to the rear to provide improved toilet accommodation. This application was approved by the Planning Committee 28th September 2007.
07/02195/B proposed a revised scheme to the previously approved refurbishment proposal. The main changes from the previously approved scheme consisted of an increase in the length of the conservatory and revisions to the conservatory roofline which would extend higher up the façade. Also proposed was a more prominent central entrance to the west elevation with the projecting gable being continued at first floor level. The rear extension was reduced in length with revised steps and associated railings being installed. This was approved.
This application proposes further minor revisions to the scheme. These consist of the addition of a window in the western elevation of the original building at ground floor level, the reduction in size of a lantern roof light on the flat roof to the rear of the building and the reconfiguration of the external staircase.
REPRESENTATIONS
The Department of Transport Highways Division does not object to this application. German Parish Commissioners indicate no objection to this application. The Department of Transport Drainage Division does not object to this application subject to a condition.
ASSESSMENT
The proposed revisions are considered to represent an improvement over the previously approved scheme in that the new window would be installed in place of a blocked up aperture. This would improve the appearance of the building. The reduced lantern light would not be visible from public vantage points and the revised external staircase would be acceptable in terms of its design and scale.
The proposal is considered to be acceptable and without detriment to the visual appearance of the building or the street scene.
RECOMMENDATION
Permit.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the refurbishment of restaurant including new conservatory (comprising amendments to PA 07/01232/B), Tynwald Restaurant, Main Road, St Johns, German as shown by 01, 02, 31F, 32F, 33D, 34D, 36B, 37B and 38 A all received 19th August 2009.
C 3. There must be no discharge of surface water to the main foul sewer.
C 4. There must be no discharge of fat or other food waste to the public sewer. It will be the responsibility of the developer/occupier of the premises to provide satisfactory means of disposal for such waste.
