The application sought permission to alter and extend Ballaqueeney Lodge on Ballaquayle Road, Douglas, by extending the south eastern corner of the property. The site is not within a Conservation Area. The extension would be screened from any public highway by the existing dwellinghouse, so there would be no visible impact on the character of the locality. The main planning issue was a proposed first-floor window on the eastern elevation, facing a vacant neighbouring site that already has planning permission for residential development. The officer assessed whether this window would cause overlooking or loss of privacy to future residents. The window would be 11.5 metres from the boundary, and substantial trees within the neighbouring site are protected as part of that development.
The extension was approved because it would be hidden from public view by the existing house and would not harm the visual amenity of the area. The first-floor window facing the eastern boundary was judged acceptable given the 11.5-metre separation distance from the boundary and the protection of substantial trees on the neighbouring site, which together were considered sufficient to prevent overlooking or loss of privacy.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This permission relate to alterations and erection of an extension as shown in drawing numbers P00, P01, P02, P03 and P04 date stamped 24th August 2009.
