The application site forms the curtilage of Lower Glentramman Farm, Garey Road, Garey located on the eastern side of the Garey Road and north of the Lezayre Road (A3). Within the farm there a number of buildings which includes a single storey building (referred too as Lower Glentramman Farm Chalet) south of the Lower Glentramman Farm House.
The majority of the application site is within an area recognised as being an area of 'white land' under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area; but is within an area zoned as High Landscape or Coastal Value and Scenic Significance.
Whilst there are a number of planning applications within this site, none relate to the single storey building (Lower Glentramman Farm Chalet).
The application seeks approval for the installation of a gas bulk tank.
Lezayre Parish Commissioners have approved the application but make the following comments:- "Although the Commissioners have approved this application they do not recall a change of use application for the chalet. From the report into the appeal for planning application number 06/00692C Appeal number AP06/0174 the inspection ask questions in relation to this building.
Quote "At the hearing I raised the question of a different building in the farmyard which from an external inspection, appeared not to be in agricultural use. I have now received further representations on this form the parties. The Planning authority have no record of planning permission ever having been given for its use for tourist accommodation, ancillary living accommodation or as a separate dwelling. The appellants have submitted information which they say demonstrates the use of "The Chalet" as a fully habitable dwelling for a period of at least four years, thus they say, it has a lawful use for that purpose".
Under Town and Country Planning, has a Certificate of Lawful Use for this building ever been applied for and approved?"
The owner/occupier of Kerrowdhoo, Glen Duff, Lezayre, has objected to the application which can be summarised as; previous Inspectors queried the lawful use of the chalet.
The proposal would be to install a bulk tank, which would replace the existing gas tanks which currently serve the building referred to as "chalet". The use of the chalet as described is unauthorised and does not have planning permission to be used for living accommodation of any type.
The gas tank would have a total width of 1.5 metres, a depth of 0.4 metres and a maximum height of 0.8 metres. The proposal would be sited in a position which would have no visual impact when viewed from the adjacent public highway due to a 2 metre high block wall. Therefore from a visual impact upon public and private amenities it is considered appropriate.
The application is for a replacement fuel container, the use of the building has not been considered given a source of heating can be required in any outbuilding. Therefore the approval of the oil tank does not extend consideration to the use.
In conclusion for these reasons given it is recommended the application be approved.
