The site represents a small piece of land to the north east of Fistard Road and accessed from a minor (private) road which runs to the north and accesses six dwellings - Porthaven, Fairhaven, Creglands (the applicant's residence), Keeill Pharick and Highfield all of which lie on the opposite side of the road to the application site.
The application site accommodates two garages which are linked by a third, more recent addition. All three garages are flat roofed and linked internally.
The site lies within an area designated on both the Isle of Man Planning Scheme (Development Plan) Order 1982 and the draft Port St. Mary Local Plan as Residential.
Planning permission has been sought for the following developments on this site: PA 85/0139 - extension to existing garage block to form two additional single garages - permitted PA 85/0728 - construction of block of 2 single garages - permitted PA 00/0635 - approval in principle for erection of dwelling - refused on review PA 07/0534 - approval in principle for erection of dwelling - permitted on appeal PA 08/2315 - erection of a dwelling with garage - refused on appeal.
Proposed now is retrospective permission for the later addition to the group of garages. The garage is flat roofed, like its neighbours and of a similar size, height and shape. The garage does not project any further back on the plot than does the existing rear garage and is finished in the same materials.
Port St. Mary Commissioners raise no objection to the application. Acting as the drainage authority, Port St. Mary Commissioners suggest that the applicant should discuss with them any proposal to change the drainage to the site and state that surface water should not be discharged to the main foul sewer. No information is provided in respect of the drainage of the site although as the building has been in placed for some time, if the property is connected to the foul sewer contrary to the Commissioners' requirements, this should have been dealt with when the building was connected to the system.
Department of Transport Highways and Traffic Division raise no objection to the application.
The building has been in place for a number of years and has not given rise to any concerns other than when applications were submitted for the re-development of the site for residential purposes. The extension is not generally visible from the public highway and has no detrimental visual or other impact. It is a garage building built between two existing garages in a residential area and indeed there are no objections to the proposal.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

This permission relates to the garage extension which is already in place and as shown in drawings 20.1.09 and the site and location plans all received on 20th April, 2009.

The building may be used only for the private storage and may not be used for commercial purposes.
