The site represents the footprint of an approved building situated to the south west of the main estate road through Balthane Industrial estate. the site lies within a larger area edged blue which is also owned by the applicant and which accommodates two existing industrial buildings to the east served by two accesses on the northern and southern sides of the buildings with car parking around the rear and front of these buildings.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Industrial.
Planning permission has been sought and granted for the erection of industrial units on the site under PA 08/0338.
Permission is now sought for the development of the same building as was previously permitted but with a stepped roof profile to take account of existing ground levels and to avoid digging into the site.
The size and appearance of the building remains as approved previously as does the parking and access. The building is (still) to be finished in grey sheeting with blue edging.
Malew Parish Commissioners and Department of Transport Highways and Traffic Division raise no objection to the application.
Department of Transport Drainage Division recommend conditions regarding foul and surface water drainage. They state that the application states that surface water will be discharged to "existing drainage": the application form actually states that surface water will be discharged to the surface water drain and as such a condition requiring no surface water to be discharged to the main foul sewer is not necessary as this is not what is proposed.
The proposal represents the construction of industrial units on land allocated for this purpose, the only change to the approved scheme is the profile of the roof, which results from an attempt to minimise disruption to existing ground levels and thus the energy expended in excavating the ground and the need for retaining walls and the disposal of material. The scheme now proposed has significant advantages to it.
The site does not include the parking, as with the plans submitted previously. However a condition could be applied to retain the parking shown in the submitted plans in connection with the approved units.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of industrial units and associated parking and access as shown in drawings GA1/A, GA4/B, GA300/B and GA1/1250/B all received on 22nd April, 2009.
C 3. The vehicle parking shown in drawing G300/B must be retained for use in association with the approved industrial units.
C 4. The building(s) may be used only for general industrial purposes and including storage and distribution.
