The application sought permission to erect a dwelling and garage on a parcel of land between existing residential properties on Ballaragh Road in Laxey. The site is zoned for predominantly residential use under the Laxey and Lonan Area Plan Order 2005 (area 7), with policy L/RES/PR/6 permitting up to three new dwellings subject to satisfactory access and drainage arrangements. The proposal was assessed as a revision of a previously approved reserved matters scheme (06/01755/REM), itself flowing from an outline approval (06/01251/A) for three split-level detached dwellings on the site and adjoining land. The officer concluded that the differences between the earlier approved dwelling and the current proposal were acceptable and would not adversely affect public or private amenity in the surrounding area. Permission was granted by delegated decision in August 2009, subject to three conditions.
The proposal was a modest revision of a dwelling already approved on the same site.
Policy L/RES/PR/6 (Area 7)
This land will be considered suitable for the development of a maximum of three new dwellings. Access and drainage arrangements must be made in accordance with the requirements of the Department of Transport.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This approval relates to drawing no.s HLK/09/0133/1, HLK/09/0133/2, HLK/06/0322/1 and HLK/06/0322/4b date stamped the 30th April 2009.
Condition 3
Prior to the occupation of the dwelling the vehicular access arrangements and sight lines must be set out in accordance with drawing no. HLK/06/0322/4b date stamped the 30th April 2009.
