The application site comprises the curtilage of a detached property known as Milntown, which is located at the northern end of Glen Auldyn in Lezayre. The site is bounded by Lezayre Road to the North and Glen Auldyn Road to the East. The property is a large former dwelling that is listed on the Protected Buildings Register due to its significant architectural and social interest. There is a concurrent planning application (09/00352/GB) for the proposed development.
The proposed development comprises an amendment to the development approved under previous planning application 07/02155/GB and consists of a revision to the design and layout of a paved area adjacent to the proposed restaurant extension.
The application site has been the subject of a number of previous planning applications, one of which is considered specifically material to the assessment of this current application:
Planning application 07/02156/GB sought Registered Building Consent for alterations and extensions to existing house to create a restaurant, shop, public access and parking areas including the demolition of existing lean to conservatory. This previous planning application was considered and approved on the 11th April 2008, with the approval decision notice issued on the 16th April 2008.
Lezayre Parish Commissioners recommend that the planning application be approved.
In terms of land use planning the application site is designated within a) an area of low density housing in parkland; and b) an area of high landscape or coastal value and scenic significance under the 1982 Development Plan Order.
In terms of strategic plan policy, in addition to policies that identify general planning considerations applicable to the assessment of the planning application, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current application:
Environment Policy 32 states: "Extensions or alterations to a Registered Building which would affect detrimentally its character as a building of special architectural or historic interest will not be permitted."
The application seeks Registered Building Consent for an amendment to the development approved under previous application 07/02156/CON and consists of a revision to the design and layout of a paved area adjacent to the proposed restaurant extension.
The change from development approved under previous planning application 07/02156/CON to that proposed by the current application is relatively minor. Having discussed the proposed amendment with Steve Moore, Building Conservation Officer, it is considered that the proposal is unobjectionable and acceptable.
It is recommended that the planning application be approved.
It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Lezayre Parish Commissioners.
