1.0 THE APPLICATION SITE - 1.1 The application site is the residential curtilage of Derbyhaven House, a three storey mid terraced dwelling located on the western side of the highway, Derbyhaven. - 1.2 The application dwelling is neighboured by Marine Court Apartments to the south and Traa-Dy-Liooar to the north.
2.0 THE PROPOSAL - 2.1 The planning application seeks approval for the erection of a flat roofed single storey extension to the western elevation. - 2.2 The extension would project just less than 4.6 metres from the rear elevation, have a length of 10.2 metres and height of just less than 3 metres. - 2.3 The extension would be finished in Scottish larch cladding with the roof finished in 'metsteam' standing seam zinc. The windows and sliding doors would be powder coated grey aluminium framed.
3.0 PLANNING HISTORY - 3.1 The application site has been the subject of seven previous planning applications all of which have been listed below and were all granted planning approval unless otherwise stated:
PA 15/00612/B: Demolition of existing boathouse and erection of extension to dwelling to provide ancillary living accommodation (comprising amendments to PA 14/01003/B). This application is currently pending consideration.
PA 14/01003/B: Demolition of existing boathouse and erection of extension to dwelling. PA 12/00706/B: Conversion of boat house to gym and alterations and extensions to dwelling (amendments to PA 11/00733/B). PA 11/00733/B: Conversion of boat house to gym and alterations and extensions to dwelling.
PA 97/00741/B: Internal and external alterations to Derbyhaven House. PA 97/01402/B: Installation of uPVC windows to replace existing. PA 91/01273/B: Installation of 1 tonne LPG tank. This previous planning application was refused.
4.0 PLANNING POLICY - 4.1 In terms of local plan policy, the site lies within an area zoned as Existing Residential under the Area Plan for the South 2013. The Plan provides further information about the Derbyhaven area at Appendix 4:
5.0 REPRESENTATIONS - 5.1 At the time of writing there have been no written representations made regarding the current planning application.
6.0 ASSESSMENT - 6.1 The fundamental issues to consider in the assessment of this current planning application are the impact of the extension on the residential amenity of neighbouring properties and the visual impact upon the locality and surrounding landscape. - 6.2 The property that is considered to be most affected is Traa-Dy-Liooar. The extension would be erected alongside the existing boundary which has a height of 2.6 metres. The extension proposed would protrude approximately 300mm above the existing boundary that is shared with the neighbouring property. - 6.3 It is considered necessary to assess the impacts of the extension in terms of loss of light and whether or not it is considered that the extension will appear overbearing and have a harmful impact upon the residential amenity of the neighbouring property. - 6.4 As the application site is to the south of Traa-Dy-Liooar, there may be occurrences of some loss of sun at light however this would be minimal given the minor protrusion of the extension above the existing boundary. - 6.5 It is considered that what would be visible of the extension from Traa-Dy-Liooar would not be of a level or scale that would result in harm to the amenity of the neighbouring dwelling with regards to the outlook from Traa-Dy-Liooar. - 6.6 In terms of the visual impact of the extension within the locality and landscape, the extension would be partially visible from over 550 metres west of the application site. However, as one neared the application site along Derbyhaven Road the extension would not
be visible given the siting of the application and positioning of the buildings within Chapel Court. As such, it is judged that the development proposed under this scheme would not have a harmful impact upon the character and quality of the area or the visual appearance of the main dwellinghouse.
7.0 RECOMMENDATION - 7.1 Overall it is concluded that the planning application is in accordance with General Policy 2 and Paragraph 8.12.1 of the Isle of Man Strategic Plan 2007 and as such it is recommended that the planning application be permitted.
8.0 PARTY STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 the following persons are automatically interested persons:
