Planning application number 08/00294/B, which was approved at an Appeal, is very similar in that the applicant was trying to optimise the use of the proposed site and develop the land with seven dwellings rather than the maximum three that has been stated in the Sulby Local Plan. The Appeal Inspector recommended that the appeal be dismissed and the Planning Committee's decision to grant planning permission be up held. The Inspector also concluded that "Housing Policy 6 calls for the local plan development briefs to be followed. However this policy also states that briefs should not be needlessly prescriptive. In this case, to prescribe 3 dwellings on this site could be construed as needlessly prescriptive. This is because there is no explanation as to why only 3 dwellings should be proposed on this site. It is clear that 7 dwellings could be accommodated satisfactorily on the site. Furthermore 7 new houses would be an efficient use of this site. By contrast a low density scheme of just 3 dwellings on the same site would not make the best and most efficient use of this valuable site in Sulby - in fact, it is the last remaining housing site in Sulby".
The initial issues with the surface water drainage have been addressed. The applicant employed a professional engineer to provide the required drainage calculations. The engineer liaised thoroughly with the Drainage Division throughout the design stage and provided a drainage scheme with an attenuated discharge volume of 7L/sec/Ha, see engineer's drawing number 947/100 attached at Appendix 7, which meets with the Drainage Divisions approval and complies with Manx Sewers for Adoption.
We would ask the Planning Appeals Inspector to take the preceding comments and the following Appendices, together with all previously submitted drawings, photographs and documentation, in support of our planning application, for the residential layout for four building plots on land adjacent to the Ginger Hall Hotel, Ballamanagh Road, Sulby, Lezayre, into consideration at the Planning Appeal and uphold the approval of our proposals.
