In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: M P Associates Proposal: Erection of a detached dwelling at: Plot 1 Field 312909 Land Adjacent To Balladoyne Estate Main Road St Johns Isle of Man
which was considered on 20th March 2009, for the reasons set out below.

Reason(S) For Refusal:
- The proposed dwelling would be excessive in height and would therefore be overly prominent in the landscape as viewed from Peel Road (A1) resulting in an adverse impact upon the views across the site towards Slieau Whallian contrary to the provisions of POLICY:RES/P/1 and POLICY:OS/P/2 of the St Johns Local Plan (Planning Circular 6/99).
- The application fails to provide details of a temporary access to serve construction vehicles and as such the proposed development would be contrary to the Development Brief for the site and POLICY:RES/P/1 set out within the St Johns Local Plan (Planning Circular 6/99).
- There is no planning approval for roads or sewers for the site and as such the dwelling proposed cannot be accessed or serviced. It is therefore considered that this application is premature pending the approval of such matters.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
