The site represents the curtilage of Ballavayre Farmhouse, situated on the western side of the Ballakilpheric Road (B44)to the south of the chapel. The site accommodates a number of buildings, all finished in stone, as well as the stone farmhouse which is of traditional appearance and character. To the rear of the cottage are two outbuildings, attached to the cottage, and to the west of this is a detached stone barn with two floors of accommodation.
The site lies within an area designated on the Arbory and East Rushen Local Plan as an Area of High Landscape or Coastal Value and Scenic Significance with an area of interest to nature conservation close by.
The following applications have been submitted in respect of this application: PA 94/01746/B - Alterations and construction of conservatory, Ballavayre Cottage, Ballakilpheric, Rushen.

Now proposed is the demolition of the two outbuildings attached to the dwelling, and the conversion of the detached barn to garaging. The works involved in this include the removal of an internal wall, introduction of a larger aperture in the end elevation, removal of stone external steps, replacement of a side door with a window. All windows and doors are to be painted timber and the walling to be repointed.
Department of Transport and Rushen Parish Commissioners indicate that they have no objection to the application.
Department of Transport Drainage Division indicate that a condition should be attached to require that no surface water be discharged to the main sewer. The application states that surface water will be discharged to a new soakaway and as such, such a condition is not necessary.
The use of an existing attractive building for garaging rather than the erection of a new building for such purposes, should be encouraged. The alterations to the building will have a negligible impact on the building itself and the new use will ensure maintenance and the retention of the building which adds to the character of the farm group.
The removal of the outbuildings may result in the removal of the roadside wall, as the building wall forms part of the wall. However, the Town and Country Planning (Permitted Development) Order 2005 requires that new walling within the curtilage of a dwelling house matches the materials of the main wall of the house and as such any replacement walling would have to be finished in stone, to match the existing.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This permission relates to the demolition of the existing outbuildings as shown on the permitted drawings and the conversion of the barn to garaging all as shown in drawings 09/04/01 and -/02 and the location plan all received on 23rd February, 2009.
