The site represents the residential curtilage of an existing dwelling situated on the south eastern edge of Port Erin, backing onto agricultural open space and fronting onto Erin Way. The property is one in a row of eleven detached properties, some of which have conservatories on the rear.
The application site has no rear extension but has centrally positioned patio doors.
The site lies within a wider area of Predominantly Residential on the Port Erin Local Plan of 1990.
The dwelling was approved as part of the overall development of this wider area, under PAs 01/1720, 03/1219 and 03/0479 all permitted.
Proposed here is the erection of a conservatory 5.2m wide and projecting into the rear garden by 3.7m and will be approximately 3.5m high - 2.1m to the eaves. The conservatory will be positioned such that the northern gable will be flush with the northern gable of the dwelling and thus, 1.4m from the boundary with number 10. The structure will be framed in plastic with a dwarf wall up to a height of 0.6m.
Port Erin Commissioners indicate that they do not oppose the application.
The proposal should be judged against the provisions of General Policy 2 which states:
"Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
a) is in accordance with the design brief in the Area Plan where there is such a brief; b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; e) does not affect adversely public views of the sea; f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; g) does not affect adversely the amenity of local residents or the character of the locality; h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; i) does not have an adverse effect on road safety or traffic flows on the local highways; j) can be provided with all necessary services; k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and n) is designed having due regard to best practice in reducing energy consumption."
Other properties already have conservatories on the rear and number 16 has permission for a solid-walled annex (PA 08/1575). The conservatory will not unreasonably affect the amenities of those in the adjacent properties and the conservatory will not look out of place in the landscape which is primary built up.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This permission relates to the erection of a conservatory as shown in drawings received on 8th January, 2009.
