ON APPEAL: PA06/147 – Salamander (Perwick Bay) Limited Port Erin Hotels Limited – Erection of 21 apartments in two blocks with associated parking to replace existing hotel, Port Erin Imperial Hotel, Promenade, Port Erin
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
The Minister has considered the report, but does not concur with all of the appointed person's conclusions. However, he does concur with the judgement in paragraph 40 of the report, where it is stated that:-
"The scale of the proposed building would be such that it would be dominant in the northern end of the sea front"; and that
" .. [it] may also be perceived as being the tallest building on the rising land towards the end of development along the promenade. The cessation of development at the Golf Course would appear more abrupt".
The Minister has also noted that the appointed person has "some sympathy with the appellant's view that this would not be an improvement to the panorama".
Since the Minister concurs with these conclusions, and judges that the building would be at least one storey too high, and that the height and bulk of the tower would be such as to render it incongruous in important public views of Port Erin Promenade, he does not accept the recommendation that the appeal should be dismissed, and has directed that the application should be refused. Formal notice of this decision is attached to this letter.

Notwithstanding his concerns in relation to the height and bulk of the proposed building, the Minister has also noted that, in terms of overall design and site layout, this scheme is in fact superior to that which already has planning approval. In these circumstances, he has expressed the hope that, despite the refusal of this particular proposal, the opportunity is nevertheless taken to formulate a scheme which not only embodies the positive elements of the present design, but also acknowledges in greater detail the traditional features of adjacent hotels.

In pursuance of his powers under the above Acts and Order the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby REFUSE the application by Salamander (Perwick Bay) Limited Port Erin Hotels Limited – Erection of 21 apartments in two blocks with associated parking to replace existing hotel, Port Erin Imperial Hotel, Promenade, Port Erin, for the following reasons:-
(1) The proposed building would be at least one storey too high, and the tower would be too high and bulky, rendering it incongruous; the development would thus have an adverse impact on important public views of Port Erin Promenade.
