Officer's Report
The Site
The site represents the curtilage of a newly created car sales and hire facility within Balthane Industrial Estate, on the north eastern side of the estate road. The site accommodates a building with parking spaces, landscaping and lighting surrounding it. Access is from the minor road to the north east of the main spine road.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Industrial.
Planning History
Planning permission was granted for the erection of the car sales and hire operation under PA 07/2363 and advertising signage approved under PA 08/1126.
The Proposal
Now proposed is the conversion of some of the landscaped space to the rear of the building, to parking spaces. The landscaped area represents approximately 11m by 23m and as approved accommodates a bin store. Now proposed are 14 parking spaces in a tandem arrangement. The bin store is to be re-arranged close by.
Representations
Malew Parish Commissioners indicate that they do not oppose the application.
Department of Transport Highways and Traffic Division submit no response to the application.
Department of Transport Drainage Division request that a condition be attached to any approval requiring that no surface water be discharged to the main foul sewer.
Assessment
The landscaped space is behind the building and does not contribute significantly to public amenity and its loss would not be unacceptable. The previous approval required there to be a minimum of nine parking spaces to be reserved for visitors. This condition should be attached to any approval of this latest application and bearing in mind that there are to be more parking spaces, the provision of spaces for visitors is more likely to be more easily achieved.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the creation of fourteen car parking spaces as shown in drawings APL/110 and -/111 both received on 13th January, 2009.
C 3.
There must be provided a minimum of nine parking spaces reserved for visitors which are available for such at all times.
