Planning approval to construct a new dwelling on land adjacent to Brakentwaite was granted on 25th June 2014. PA 14/00500/B refers.
In December 2014 McCavana Timber Frame Construction were appointed to carry out the works based on a commencement date of January 2015 for completion by September 2015.
In April 2015 the applicant was advised by letter from the Planning Enforcement Officer that a temporary access road created by the contractor was not part of the permitted development and that a planning application for the temporary works would need to be submitted together with a tree report.
The tree report submitted by McCavana Timber Frame on 8th May highlighted that damage had been caused to a number of trees with recommended remedial works taking the form of the removal of some trees and the pruning of others.
In a letter dated 18th May the Planning Enforcement Officer advised the applicant that the Department considers condition 6 of the original approval notice had not and now cannot be complied with and that they must re-apply for planning permission as a whole.
The damage to the trees is extremely regrettable and certainly not something that was endorsed by the applicant.
The applicant worked closely with the planning department to secure planning permission for the proposed home and they have every wish to ensure that it is completed in a satisfactory manner.
The purpose of this application is therefore to seek planning concurrence to the continuation of the development as previously approved together with mitigation works to compensate for damage caused by construction activities.
Construction work is well advanced. Whilst windows have yet to be fitted and he balcony area needs its weather poor finish, the fabric of the building is otherwise weather-tight. Drainage and services are in place and all major elements of excavation works have been completed.
Outstanding construction activities associated with the original approval are therefore largely confined to window installation, internal fit-out, the application of external finishes to the building, and hard landscaping works.
All other construction activities have been suspended bar the removal of the temporary access road and other minor works to ensure the building is left water-tight and the site is left safe, and fencing has been erected on the site side of the eastern tree belt encompassing the site.
As previously stated, the tree report highlighted that damage had been caused to a number of trees. Recommended remedial works include the removal of 3no trees with crown reduction/pruning of 3 others, and, in mitigation, the planting of 15 native species trees.
The planning application attached herewith comprises the original approved drawings with the site plan updated with tree information to take account of the remedial works recommended in the Trees IM report together with the associated mitigation works i.e
All tree work mentioned in the tree report will be carried out under the supervision of Trees IM including the other more general tree maintenance work associated with T6, T7 T8 T12 & T13.
Ensuring the surrounding landscape is returned to normal as quickly as possible is a major priority and other beneficial works such as the incorporation of woodland flowers within natural tree belt areas will be implemented at the earliest opportunity.
Mr and Mrs Wilkinson sincerely apologise for the tree damage that has been caused by their contractor and will do everything they can to ensure the works are completed to everyone’s satisfaction.
