This application sought permission to erect a replacement dwelling at Cronk Ny Killey, Dreemskerry, Ramsey, Isle of Man, within the parish of Lezayre. The Planning Committee refused the application on 20 January 2011. The proposed dwelling would have a floor area 118% larger than the existing building it was intended to replace. This was considered disproportionate and out of keeping with the character of the surrounding area, which is recognised as having High Landscape Value and Scenic Significance and lies within the Maughold Conservation Area. A second reason for refusal was that the increased size of the dwelling would expand the residential curtilage, amounting to an unwarranted encroachment into the countryside and further harming the landscape character. The case officer had recommended approval, but the Committee did not follow that recommendation.
The Planning Committee refused the application. The proposed replacement dwelling would be 118% larger in floor area than the existing one, which was considered too great an increase and contrary to housing policy on replacement dwellings. The scale of the new building would harm the character of the surrounding landscape, which is designated as an area of High Landscape Value and Scenic Significance and falls within the Maughold Conservation Area. The enlarged residential curtilage would also represent an unwarranted encroachment into the countryside.

POLICY CA/2 SPECIAL PLANNING CONSIDERATIONS When considering proposals for the possible development of any land or buildings which fall within the conservation area, the impact of such proposals upon the special character of the area, will be a material consideration when assessing the application. Where a development is proposed for land which, although not within the boundaries of the conservation area, would affect its context or setting, or views into or out of the area; such issues should be given special consideration where the character or appearance of a conservation area may be affected.
