I refer to the abovementioned planning application.
In accordance with Article 10(9) of the Town and Country Planning (Development Procedure) (No 2) Order 2013, I herewith give notice of the decision as follows.
On the 6th August 2015, the Council of Ministers considered the recommendations of the Planning Inspector and determined to approve the application subject to the conditions specified below.
Conditions of Approval
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 14 of the Town and Country Planning (Development Procedure) (No 2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

Notwithstanding the height of the ball stop fencing shown on the permitted plans, full details of fencing to stop the passage of golf balls onto the site shall be submitted to, and approved in writing by, the Planning Authority prior to the commencement of the development. The details to be submitted shall include the detailed design of the fencing, including with respect to the supporting posts, and the height of the fencing, including any variations in its height along its length. The approved fencing must be erected prior to the undertaking of any other part of the development hereby approved, and the fencing shall be retained at all times thereafter.
Reason: To safeguard the amenities of those living in the approved dwellings and the safe operation of the golf course.
Prior to the undertaking of any part of the development hereby approved, including any site clearance in association with this approval, an ecological survey of the site and existing building must be undertaken, paying particular attention to the presence of lizards, owis and bats which are all protected under the Wildlife Act 1990, and providing appropriate measures for mitigation of any impacts. The survey report, including any mitigation measures, shall be submitted to and approved in writing by the Planning Authority prior to any work commencing on site and the development must thereafter be undertaken in accordance with the approved findings and recommendations.
Reason: To accord with Environment Policy 4 of the Isle of Man Strategic Plan.
The visibility splays shown on the approved plans shall at all times be kept clear of any obstructions in excess of 1.05m in height, including by the trimming of any vegetation within those splays to below that height.
Reason: In the interests of highway safety.
Prior to the commencement of development a method statement shall be submitted to and approved in writing by the Planning Authority giving full details of where and how construction vehicles and plant, including vehicles used by construction operatives to travel to and from the site, will be parked. The approved method statement shall be complied with at all times during the period of construction and other related works on the site.
Reason: In the interests of highway safety and to protect the amenities of adjacent residents.
In accordance with Article 10(10)(c) of the Order, please be advised that the decision of the Council of Ministers is binding and final (subject to the possibility of judicial review by petition of doleance).
