I refer to the appeal in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) (No 2) Order 2013, I herewith give notice of the appeal decision.

The Minister for Environment, Food and Agriculture, the Hon R A Ronan MHK, has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Department's approval of the application under Article 6 of the Town and Country Planning (Development Procedure) (No 2) Order 2013 should be upheld, and that the application should be Approved subject to conditions. Formal notice of this decision is attached.

THE TOWN AND COUNTRY PLANNING (DEVELOPMENT PROCEDURE) (No2) ORDER 2013

In pursuance of his powers under the above Act and Order, the Minister for the Department of the Environment, Food and Agriculture, the Hon R A Ronan MHK does hereby in the name of and on behalf of the Department APPROVE planning application 15/00166/B by Mr Mathew \& Mrs Lynda Ingham for Erection of an equestrian building to provide an indoor riding school, stables and feed, tack and equipment store with associated car parking - Stables, Ballaclucas Farm, Top Road, Crosby, Isle of Man subject to the following conditions:-

1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with Article 14 of the Town and Country Planning (Development Procedure) (No 2) Order 2013, and to avoid the accumulation of unimplemented planning approvals.

1. The timber boarding on the building hereby approved shall be stained or painted dark green or dark brown, or as otherwise approved by the Department, and this colour shall be applied within one month of the completion of the building and prior to its use.

Reason: To minimise the visual impact of the new building in the landscape.

1. Before development starts, a landscaping scheme shall be submitted to and approved in writing by the Department. The scheme shall include details of all trees and shrubs and a timetable for their planting, and it shall be implemented as approved. Any trees or shrubs which within a period of five years from the date of planting die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species.

Reason: The landscaping of the site is an integral part of the scheme and must be implemented as approved in the interests of the character and appearance of the surrounding countryside.

1. No additional external lighting shall be installed without the prior grant of planning approval.

Reason: To preserve the visual amenity of the area and the living conditions of those in the vicinity.

Note: This approval relates to Drawing Numbers P10-01, P10-02, P10-03, P10-04 and P12-01 all date stamped as received on 17 February 2015, and Drawing Number P11-01 date stamped as received on 29 April 2015.
