1.0 THE APPLICATION SITE - 1.1 The application site is the curtilage of 3 Ballamillaghyn, a single storey detached dwelling sited on the northern side of Ballamillaghyn, Braddan.
2.0 THE PROPOSAL - 2.1 The current planning application seeks approval for the replacement of the existing polycarbonate conservatory roof with new brown metrotile lightweight roof tiles which would match the roof of the main dwellinghouse. - 2.2 The existing conservatory is located on the rear elevation of the dwelling.
3.0 PLANNING HISTORY - 3.1 The application site has been the subject of a number of previous planning applications relating to various extensions and alterations to the dwellinhouse.
4.0 PLANNING POLICY - 4.1 The application site lies within an area zoned as Predominantly Residential under the Braddan Local Plan 1991. - 4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically relevant to the assessment of this current planning application:
General Policy 2 states: "Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
g) does not affect adversely the amenity of local residents or the character of the locality;
5.0 REPRESENTATIONS - 5.1 Braddan Parish Commissioners have no objection to the current planning application (02/03/2015).
6.0 ASSESSMENT - 6.1 The application seeks approval for the installation of a replacement conservatory roof. The main issue to consider in the assessment of the application is the impact upon the character and appearance of the property and the surrounding area. - 6.2 As the proposed roof tiles would match the existing roof tiles of the main dwelling it is considered that the development would be an enhancement to the existing property by providing a uniform appearance throughout. - 6.3 The replacement conservatory roof may be partially visible from neighbouring dwellings but not from the highway given the siting of the conservatory. The proposed conservatory roof tiles, which would be a colour and material to match that of the dwelling, will provide a more constant and unbroken appearance than is currently the case and thus enable a more successful integration of the conservatory with the dwelling itself, enhancing the appearance of the dwelling as viewed from neighbouring properties. 7.0 RECOMMENDATION
7.1 Overall, it is considered that the development proposed is acceptable and is concluded to accord with the provisions set out in General Policy 2 of the Isle of Man Strategic Plan 2007 and as such is recommended for approval.
8.0 PARTY STATUS - 8.1 In line with Article 6(4) of the Town and Country Planning (Development Procedure) (No2) Order 2013, the following Persons are considered to have sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application: the applicant or, if there is one, the applicant's agent; the owner and occupier of the land the subject of the application, Highway Services, and the Local Authority in whose district the land the subject of the application sits.

C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
This approval relates to Drg No JTM-41-P-10-01 and photograph showing the application dwelling and existing roof tile all date stamped as received 13th February 2015.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control /Head of Development Management/ Senior Planning Officer.
