1.3 The building on site today is a long, flat roofed structure with significant amounts of glazing on its frontage with a more functional elevation to the rear, brightened by the entrance at the northern end of the car park. The frontage has a horizontal emphasis broken into sections which have different glazing treatments with the Kursaal having projecting first floor bays, the Cushag Suite function room having square bars at this level, the Paragon Restaurant having a striking blue facade and the Shearwater Suite function room having a projecting section which steps forward of the rest of the frontage and with recessed windows and a white horizontal fascia above.

Although hailed as true ground-breaking architecture when it was first constructed in the 1960s, the present modern appearance of the Hilton Hotel unfortunately jars the rhythm and line of the majority of buildings which make up the curve of the sea frontage of Douglas.

2.7 Whilst the application building is not Registered, the adjacent Castle Mona Hotel is and the Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man and Strategic Policy 4 are clear that developments which adversely affect a Registered Building shall not be permitted (RB/5).

5.1 The critical issues in this case are the visual impact on the character and appearance of the building itself, the impact on the special character and appearance of the Conservation Area - having regard to whether the proposal preserves or enhances the character and appearance of the area and finally whether the proposed works would have any impact on the adjacent Registered Building.
Impact on the character and appearance of the area (General Policy 2, Strategic Policies 3 and 5 and Environment Policy 42)
5.2 The works would be contained to a small part of the front facade of the building and within the existing external side walls, resulting in the proposed works being visible only when one passes directly in front of this part of the building.
5.3 The building currently has a front elevation which comprises a number of different sections with the first floor having five different window styles with the upper hotel room floors above having two: as such, the proposed alterations will introduce a different style of glazing on the first floor, but amid an elevation which is already visually and architecturally differentiated along its length.

5.4 The proposed terrace will allow users of the premises to sit out and enjoy the view of the bay, providing a facility which is not presently available on the first floor.
5.5 The existing building is acknowledged in the Conservation Area Appraisal as sitting apart from the rest of the promenades in terms of its style and design and what is proposed will not change that. As such the character and appearance of the CA is being preserved and the special characteristics of the CA not affected.
5.6 The works are some distance from the Castle Mona Hotel and contained within the existing side walls of the fenestration: as such there will no impact from the proposed works on this Registered Building and the parade of shops beneath.
5.7 The works will enhance the visitor experience to this prominent Douglas hotel, casino and restaurant facility with little or no impact on the visual appearance or character of the building in which they will be accommodated, not the area in which the building sits. As such, it is considered that the works comply with all of the relevant planning policies highlighted above.

Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
Environment Policy 42: New development in existing settlements must be designed to take account of the particular character and identity, in terms of buildings and landscape features of the immediate locality. Inappropriate backland development, and the removal of open or green spaces which contribute to the visual amenity and sense of place of a particular area will not be permitted. Those open or green spaces which are to be preserved will be identified in Area Plans.

Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man
POLICY RB/5 ALTERATIONS AND EXTENSIONS In considering whether to grant planning approval for development which affects a registered building or its setting and in considering whether to grant registered building consent for any works, the Department shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses.
POLICY CA/2 SPECIAL PLANNING CONSIDERATIONS When considering proposals for the possible development of any land or buildings which fall within the conservation area, the impact of such proposals upon the special character of the area, will be a material consideration when assessing the application. Where a development is proposed for land which, although not within the boundaries of the conservation area, would affect its context or setting, or views into or out of the area; such issues should be given special consideration where the character or appearance of a conservation area may be affected.
