In this instance of the submitted application for the discharge of conditions, an amended landscape plan (05 LANDSCAPE DETAILS - REVA), an amended schedule of materials (FINISHES SCHEDULE - REVA - LQ) as well as a cover letter and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 3 and 4 of application 22/00619/B with the understanding that all planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the garage, whichever is the sooner. Any trees or plants which die or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species and that the development itself shall not be carried out unless in accordance with the approved details.
This decision is in relation to the submitted application for the discharge of conditions as well as a cover letter submitted on the 10/10/2023 and an amended landscape plan (05 LANDSCAPE DETAILS - REVA) and an amended schedule of materials (FINISHES SCHEDULE - REVA - LQ) which were submitted on the 08/01/2024.
1.0 Description - 1.1 The proposed application 22/00619/B for the erection of a detached garage was approved on 01/11/2022 subject to 4 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Conditions 3 and 4 which the applicants are seeking to satisfy. - 1.3 Specific wording of the conditions as follows:
"C3: No development shall take place until full details of soft landscaping works have been submitted to and approved in writing by the Department and these works shall be carried out as approved. Details of the soft landscaping works include details of new planting along the eastern boundary of the site showing, type, size and position of each to the north and northwest of the kennel building. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the garage, whichever is the sooner. Any trees or plants which die or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. The existing landscaping to the south of the garage should also be show on this landscaping plan showing it to be retained, unless otherwise agreed.
Reason: To ensure the provision of an appropriate landscape setting to the development."
"C4: No development shall commence until a schedule of materials and finishes and samples of the materials to be used in the construction of the external surfaces, including roofs, have been submitted to and approved in writing by the Department. The development shall not be carried out unless in accordance with the approved details.
Reason: In the interests of the character and appearance of the site and surrounding area."
2.0 Proposal - 2.1 The applicant's agent have now submitted an application for the discharge of conditions, an amended landscape plan (05 LANDSCAPE DETAILS - REVA), an amended schedule of materials (FINISHES SCHEDULE - REVA - LQ) and a cover letter. The landscaping plan includes details of the new planting along the eastern boundary of 5 medium trees including a selection of native trees they propose to use, position and size as well as confirmation existing landscaping on the southern boundary will remain untouched. The schedule of materials includes information on the materials to be used in the external construction of the development including the roof.
3.0 Recommendation - 3.1 In this instance of the submitted application for the discharge of conditions, an amended landscape plan (05 LANDSCAPE DETAILS - REVA), an amended schedule of materials (FINISHES SCHEDULE - REVA - LQ) as well as a cover letter and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 3 and 4 of application 22/00619/B with the understanding that all planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the garage, whichever is the sooner. I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
