Shore House, 33, The Promenade, Castletown, Isle Of Man, IM9 1bg
Permission was granted to convert the ground and first floors of Shore House, The Promenade, Castletown into a two-surgery dental practice, while keeping the top floor as a residential flat. The application was submitted by Harbour Quay Ltd and decided by delegated authority on 5 March 2024. Shore House is a three-storey building, previously used as a four-bedroom dwellinghouse, with a property recorded on the site since at least the 1860s. During the application process, the applicant provided additional information confirming arrangements for car parking at the Commissioners car park and details of opening hours and x-ray equipment. The officer recommended approval and the decision matched that recommendation, with four conditions attached.
The Department of Environment, Food and Agriculture approved the application on 5 March 2024. The ground and first floors of Shore House are permitted to become a two-surgery dental practice, while the top floor remains a residential flat. The officer also recommended approval, and no conflicts with the decision were identified.
Priority for new development to identified towns and villages
The proposals are therefore deemed to be compliant with Strategic Policies 2, 4 and 5
Strategic Policy 2: New development will be located primarily within our existing towns and villages, or, where appropriate, in sustainable urban extensions(2) of these towns and villages. Development will be permitted in the countryside only in the exceptional circumstances identified in paragraph 6.3. (1) Open Space is defined in Appendix 1. (2) Sustainable Urban Extensions are defined in Appendix 1 4.3.2 Appendix 3 to the Plan identifies the towns and villages, and also explains why the Department has rejected the idea of a new settlement, which was mooted in the Consultation Draft published in May 2000. 4.3.3 Each of our towns and villages has an ind ividual character arising not only from its geographical position and existing fabric, but also from its historical, cultural, and social background. This character should be protected and enhanced. Accordingly:
Design and visual impact
The proposals are therefore deemed to be compliant with Strategic Policies 2, 4 and 5
Strategic Policy 5: New development, including individual buildings, should be designed so as to make a positive contribution to the environment of the Island. In appropriate cases the Department will require planning applications to be supported by a Design Statement which will be required to take account of the Strategic Aim and Policies. 4.4 Economy 4.4.1 The Spatial Strategy identifies the Major Employment Areas around the Island. While the majority of business and employment is focused around the Douglas Metropolitan Area, there are other major employment areas at Castletown, the Airport/Freeport, Peel, Ramsey and Jurby. The Department considers the distribution of employment areas provides a spread of employment opportunities around the Island. While recognising the opportunities for small scale local employment within existing centres it is considered new employment should, in the main, be concentrated within existing settlements or those major employment areas referred to in the Island Spatial Strategy and illustrated on the Key Diagram. Existing Local and new Area Plans will provide detailed boundar ies for these areas. From time to time Government may judge it appropriate to offer financial incentives to encourage economic activity or investment in particular parts of the Island.
Development in the Service Centres
General Development Considerations
General Policy 2: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption. 6.3 Development outside of areas zoned for development
Loss of housing
Housing Policy 18: Applications which would involve the loss of existing housing which is fit for habitation or which could be made fit at reasonable cost will not usually be approved unless accompanied by firm proposals for replacement housing. CHAPTER 9 BUSINESS & TOURISM CONTENTS 9.1 Introduction 9.2 Industry, Storage and Distribution 9.3 Commerce 9.4 Retailing 9.5 Tourism CHAPTER 9 BUSINESS AND TOURISM 9.1 Introduction 9.1.1 The Government's central policies include the pursuance of "manageable and sustainable growth based on a diversified economy" and ensuring that "the Island has a population which is sufficient in skills to serve the needs of the community and the economy". These policies have enabled the Department to formulate the Strategic Economic Objectives set out in Chapter 3 (at paragraph 3.4). 9.1.2 Having regard to these Objectives, the Department has proposed Strategic Economic Policies in Chapter 4 (at paragraph 4.4). In terms of their impact on employment, these policies may be combined to produce the following single general policy:-
Community health care facilities
Community Policy 6: New community health care facilities and extensions to existing facilities will be permitted provided that they: a) would not result in an over concentration of such uses in a particular area; b) would not have an unacceptable effect on the residential or prevailing character or amenity of the area; c) would be easily accessible; and d) would not have an unacceptable impact on the local highway network. Regard should be had also to the parking standards set out in Appendix 7. 10.12 Police Service 10.12.1 Government is improving community safety through reducing the incidence of crime. The Isle of Man Constabulary is the principal agency for crime reduction and the Department works closely with the Constabulary to ensure that crime reduction is considered as part of the assessment of planning applications and new building by the Department. The Department has adopted the principles of Secured by Design (SBD) in the design of its own schemes and through the planning process. The Constabulary have suggested that this should be extended to incorporate the principles of Designing Out Crime. This includes SBD but also incorporates the principles of Defensible Space, Crime Prevention through Environmental Design and Situational Crime Prevention(1). Highways safety
Transport Policy 4: The new and existing highways which serve any n ew development must be designed so as to be capable of accommodating the vehicle and pedestrian journeys generated by that development in a safe and appropriate manner, and in accordance with the environmental objectives of this plan. 11.3.2 Notwithstanding policies within this plan which encourage travel by means other than private car it is anticipated that the number of vehicles using the Island's roads will continue to increase. This increase in demand is likely to lead to a greater need for road impro vements in order that travel can take place in a safe, effective, and environmentally acceptable manner. The Department of Transport will continue to assess the need for such improvements to public highways and undertake works where appropriate, with much of the improvement within existing roads carried out under the provisions of the Town and Country Planning (Permitted Development) Order2005. The need for improvements to the Island's highway network must be balanced against the environmental objectives of this plan.
Parking
Transport Policy 7: The Department will require that in all new development, parking provision must be in accordance with the Department's current standards. The current standards are set out in Appendix 7. 11.5.4 New development can have a significant impact in terms of the traffic generated by it and the impact on the various modes of travel. The Department considers that proposals which are likely to be significant traffic generators should be accompanied by a Transport Assessment(1) which should look at all modes of transport including access by public transport, cycling and on foot.
Condition 1
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Condition 2
The hours of use of the dental surgery hereby approved shall be as specified as part of the application submission, namely 8.30am to 5.30pm Mondays to Thursdays, Friday 9am to 1pm, and Saturdays 9am to 2pm.
Condition 3
The second-floor 1-bedroom flat hereby approved shall only be used and occupied in connection with the approved dental surgery, and shall only be occupied by persons in gainful employment of the dental surgery. The residential flat shall not be rented out or sold to persons who are not in gainful employment of the dental surgery.
Condition 4
The use of the premises, namely the ground and first floors of the property, shall only be for the purposes of a dental surgery and for no other use falling within Use Class 1.2 of the Town and Country Planning (Use Classes) Order 2019.
