Permission was granted for the installation of two replacement windows to the rear elevation of 29 Lancaster Road, Douglas, a mid-terrace red brick dwelling within a Conservation Area. The officer's report noted that the property had retained its original sliding sash windows to the front but already had top-opening casement windows to the rear. The main planning consideration was whether the replacement windows would harm the character and appearance of the Conservation Area. The application was approved under delegated authority, with one condition attached to the permission.
The Department of Infrastructure approved the application on 27 February 2015. The key planning consideration was the impact of the replacement windows on the character and appearance of the Conservation Area, and the proposal was found acceptable.
Within Conservation Areas, the Department will permit only development which would preserve or enhance the character of appearance of the area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development

Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development. 7.30 Development adjacent to Conservation Areas 7.30.1 It is often the case that important views into and out of a Conservation Area can contribute significantly to its character. It is necessary to assess the impact any development adjacent to conservation areas may have on such views.
BUILDINGS IN CONSERVATION AREAS If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows. Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction.

The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
