This application sought permission to install replacement uPVC windows to the front elevation of a two-storey dwellinghouse at 6 Upper Dukes Road, Douglas. The property sits within a predominantly residential area and falls within a Conservation Area. The central planning issue was whether the proposed uPVC windows would preserve or enhance the character and appearance of the Conservation Area. The existing front elevation includes timber sliding sash windows at first floor level and a top-opening casement window at ground floor level. The application was refused on the basis that uPVC replacement windows would not preserve or enhance the Conservation Area and would be detrimental to the visual amenities of the locality. The decision was made by the Senior Planning Officer under delegated authority.
The application was refused because the proposed uPVC replacement windows were judged not to preserve or enhance the character and appearance of the Conservation Area, and would be detrimental to the visual amenities of the locality. The existing front elevation features timber sliding sash windows on the first floor and a casement window on the ground floor, which are more in keeping with the Conservation Area setting.

Within Conservation Areas, the Department will permit only development which preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development

Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development. 7.30 Development adjacent to Conservation Areas 7.30.1 It is often the case that important views into and out of a Conservation Area can contribute significantly to its character. It is necessary to assess the impact any development adjacent to conservation areas may have on such views.
If the original windows are in place they should preferable be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows.
