This application sought permission to install replacement windows to the front elevation of 9 Church Street, Peel, a three-storey mid-terrace property in a Conservation Area. The property retains a number of traditional features, including a front boundary wall with railings. The officer's assessment noted that while the existing windows are timber, they are not the originals and do not reflect the original method of opening or glazing arrangement. As a result, they were not considered to make a positive contribution to the character and appearance of the property or the Conservation Area. The application was approved by delegated decision on 7 April 2014, subject to two conditions.
The Department of Infrastructure approved the application on 7 April 2014. The key planning consideration was the impact on the character and appearance of the Conservation Area. The existing timber windows were found not to be original and were not considered to make a positive contribution to the property or its setting, so replacing them was judged acceptable.
Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
It is considered that the proposed windows would significantly enhance the character and appearance of the property by reinstating the original method of opening. It is considered that the proposed windows would result in an overall enhancement within the Conservation Area.
Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development. 7.30 Development adjacent to Conservation Areas 7.30.1 It is often the case that important views into and out of a Conservation Area can contribute significantly to its character. It is necessary to assess the impact any development adjacent to conservation areas may have on such views.
If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare must have the same pattern and section of glazing bars and the same frame sections as the original windows.
It is considered that the proposed windows would significantly enhance the character and appearance of the property by reinstating the original method of opening.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
The development hereby approved shall not be carried out except in full accordance with the location plan, photograph, window details and site plan date stamped as having been received 27th February 2014.
