San Remo, Ballamodha Straight, Ballamodha, Ballasalla, Isle Of Man, IM9 3az
This application sought permission to erect a replacement dwelling at San Remo, Ballamodha Straight, Ballasalla, Isle of Man, along with associated external works and an extension to the residential curtilage into part of an adjacent field. The application was considered by committee and permitted on 16 October 2013, subject to compliance with five conditions set out in the decision notice. The available evidence is limited to the decision notice, so the specific planning reasons behind the approval are not fully documented here. The formal decision record lists 5 conditions.
The Department of Infrastructure approved the application on 16 October 2013, subject to five conditions. The decision was made by committee.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This approval relates to the demolition of the existing dwelling and its replacement by a new dwelling with new access and landscaping, all as shown in drawings P-01 Rev A, P03, P-04 Rev A, P05, P-06, P-07, P-08 and 13TS004-01 Rev A all received on 28th August, 2013.
Condition 3
The dwelling hereby approved may be first occupied only by the applicant, Mr. Christopher Walmsley and his carers.
Condition 4
All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwelling, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
Condition 5
For the avoidance of doubt, the triangular piece of land to the south of the dwelling and divided from it by a road, whilst being a residential garden, does not form part of the curtilage of the dwellinghouse and therefore no development can be undertaken under the 'Town and Country Planning (Permitted Development) Order 2012 Schedule 1 Part 2 "Operations within the curtilage of a dwellinghouse".
