The application at Three Acres, Ballafreer Lane, Union Mills sought to remove a planning condition that restricted occupation of the dwelling to agricultural workers. The Department of Infrastructure refused the application on 11 September 2013. Although the decision notice acknowledged sympathy with the applicant's position, the submitted evidence was not sufficient to demonstrate that there was no current or long-term need for agricultural workers' accommodation in the locality. Without that evidence, the case for lifting the occupancy restriction could not be made out.

The Department of Infrastructure refused the application. The applicant had not provided sufficient evidence to show there was no ongoing or long-term need for agricultural workers' accommodation in the area, which meant the existing occupancy condition could not be removed.
