This decision was made by the Development Control Manager in accordance with the authority delegated to her. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.
The proposed development must not be commenced until either;
Whichever is the later.

1.0 THE APPLICATION SITE 1.1 The application site is the residential curtilage 4 Furman Road, a single storey detached dwelling sited on the eastern side of Furman Road in Onchan. 1.2 The existing dwelling is finished in a pebble dash render with a pitched roof with a front pitched outrigger finished in interlocking concrete tiles. The immediate locality is characterised by a mix of properties of different form, design, size, layout and appearance.
2.0 THE PROPOSAL 2.1 This current planning application seeks the approval for the removal of a chimney stack located to the south western part of the dwelling. 2.2 The chimney stack is unused and is currently causing internal damage to the building. There would be no replacement and the aperture left would be made good.
3.0 PLANNING HISTORY 3.1 The application site has not been the subject of any previous planning applications.
4.0 PLANNING POLICY 4.1 In terms of local plan policy, the application site is designated as Predominantly Residential under the Isle of Man Planning Scheme (Onchan Local Plan) Order 2000. 4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application:
General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;

(c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption."
5.1 Onchan District Commissioners have no objection to the current planning application.
5.1 Given the nature of the planning application it is imperative to consider the impacts of the removal of the chimney on the appearance of the main dwellinghouse and street scene of Furman Road. 5.2 The bungalow is of an unusual design with an asymmetrical roof line truncated by the large and quite dominant chimney. It is considered that the bungalow may look slightly offbalance by its loss. However, the impact of this on the house as a whole is not likely to have much, if any impact on the appearance of the street scene. There is a mix of properties within the locality with a mix of designs, form and appearance. The removal of the chimney stack is not judged to have an adverse impact to the locality. 5.3 Overall, it is concluded that the planning application is in accordance with General Policy 2 of the Isle of Man Strategic Plan 2007.
6.1 It is recommended that the planning application be permitted.
7.1 The local authority, Onchan District Commissioners, is by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d), considered "interested persons" and as such should be afforded party status.
