1.0 THE SITE 1.1 The application site is the curtilage of 126 Malew Street, Castletown. The existing property is a two storey end terrace dwelling situated at the eastern side of Malew Street. The property is within the Castletown Conservation Area.
2.0 THE PROPOSAL 2.1 The application seeks approval for the installation of solar panels to the rear elevation. The panels would have a width of 2 metres and a depth along the roof plane of 1.1 metres.
3.0 PLANNING HISTORY 3.1 The previous planning applications are considered specifically material in the assessment of the current application: 3.2 Erection of summer house - 00/00617/B - APPROVED 3.3 First floor side extension - 99/00248/B - APPROVED 3.4 Internal alterations, replacement windows and erection of a conservatory - 96/00462/B - APPROVED 3.5 Construction of rear porch - 89/00712/B - APPROVED 3.6 Construction of hardstanding for off-street parking - 87/01101/B - APPROVED
4.0 DEVELOPMENT PLAN POLICIES 4.1 The application site is within an area zoned as "Predominantly Residential" identified on the Area of Plan for the South. The site is also within the Castletown Conservation Area. 4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains three policies that are considered specifically material to the assessment of the planning application. 4.3 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;

(c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption." 4.4 Environment Policy 35 states: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development." 4.5 Energy Policy 4 states: "Development involving alternative sources of energy supply, including wind, water and tide power, and the use of solar panels, will be judged against the environmental objectives and policies set out in this Plan. Installations involving wind, water and tide power will require the submission of an EIA."
5.1 Castletown Commissioners have no objection
6.1 The main issue with this proposal is whether the erection of these solar panels would have a detrimental impact upon the visual amenities of the property as viewed by the public within a Conservation Area. 6.2 It is encouraged in the Isle of Man Strategic Plan 2007 to minimise environmental pollution to air, water and land and with this proposal the best practice to reduce energy consumption is being made. 6.3 The proposed solar panels would not be apparent from public views along Malew Street, given they would be installed to the rear of the property. Perhaps the only aspect where they could be viewed by member of the public would be from the turning head (approx 40 metres away) of Ellerslie Gardens cul-de-sac to the east of the site. These views would not be prominent views, given the limited places the panels would be viewed, as the existing landscaping and buildings between the application site and the cul-de-sac. 6.4 It is also important to note that the existing finish of the property is grey slate and solar panels are dark in colour which also helps reduce their appearance. 6.5 Overall, it is considered whilst the solar panels do not add to the attractiveness of properties, they minimise environmental pollution which the Isle of Man Strategic Plan seeks to address. Therefore given the proposals would not be positioned on a prominent elevation
within the conservation area, it is considered the environmental benefits outweigh the visual impact.
7.0 RECOMMENDATION 7.1 For these reasons the proposal is considered to comply with the relevant polices of the Strategic Plan and therefore recommended for an approval.
8.0 PARTY STATUS 8.1 The local authority, Castletown Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered "interested persons" and as such should be afforded party status.
