In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Mr \& Mrs Jay Mairs, Ref 13/00646/B, for the Erection of dwelling to replace disused storage building at Outbuilding Farmhill Farm Farmhill Lane Douglas Isle Of Man subject to compliance with the following condition(s):
NOTE The applicant/developer should contact the Manx Electricity Authority to discuss power supply to the new dwelling.
The Isle of Man Water and Sewerage Authority advises that the new dwelling must be connected to the public sewers. There should be no discharge of surface water into any foul drainage system. The applicant/developer should discuss detailed drainage arrangements with the Water and Sewerage Authority ahead of the detailed design stage.
The applicant/developer should contact the Network Operations Section of the Department of Infrastructure prior to carrying out any works with the highway. Their contact number is 01624 686665.

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption.'

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. The development hereby permitted shall not be carried out except in full accordance with the following plans: Drawing Numbers HLK/12/0130 1A (survey block plan and levels); HLK/12/0130 2 (location plans and proposed site layout); and HLK/12/0130 2a (proposed elevations and floor plans) received on 30 May 2013.
C 3. The dwelling hereby approved shall not be occupied until the means of access has been constructed in accordance with Drawing NumberHLK/12/0130 2 received on 30 May 2013. There shall be no obstruction to visibility greater than one metre above adjacent ground level within a visibility splay measured across the top of the driveway and two metres back from the carriageway edge.
C 4. No works to implement this planning permission shall be carried out unless tree protection measures that accord with British Standard 5837:2012, or such other standard or specification which shall have first been submitted to and approved in writing by the Planning Authority, have been put in place to protect the trees situated with the canopy spread shown on Drawing Number HLK/12/0130 2 received on 30 May 2013. The tree protection measures shall be retained for the full duration of the construction phase.
C 5. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (or any order revoking and re-enacting that Order with or without modification) no garages or other free standing buildings shall be erected within canopy spread shown on Drawing Number HLK/12/0130 2 received on 30 May 2013, without the grant of express planning application.
