In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Malcolm Colburn, Ref 13/00616/B, for the erection of timber shed, and installation of replacement entrance gate and posts (increase in the boundary height removed from the description as it is not considered development) (retrospective) at Field 224051 Bollyn Road Ballaugh Isle of Man subject to compliance with the following condition(s):
NOTE The applicant is advised that there are overhead/underground power lines in the area and that they should contact the Manx Electricity Authority for further advice.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

The proposed development must not be commenced until either;
Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.

'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption.'
'Development will not be permitted where it would result in the unacceptable loss of or damage to woodland areas, especially ancient, natural and semi-natural woodlands, which have public amenity or conservation value.'
'Where the Department is satisfied that there is agricultural or horticultural need for a new building (including a dwelling), sufficient to outweigh the general policy against development in the countryside, and that the impact of this development including buildings, accesses, servicing etc. is acceptable, such development must be sited as close as is practically possible to existing building groups and be appropriate in terms of scale, materials, colour, siting and form to ensure that all new developments are sympathetic to the landscape and built environment of which they will form a part.
Only in exceptional circumstances will buildings be permitted in exposed or isolated areas or close to public highways and in all such cases will be subject to appropriate landscaping. The nature and materials of construction must also be appropriate to the purposes for which it is intended.
Where new agricultural buildings are proposed next to or close to existing residential properties, care must be taken to ensure that there is no unacceptable adverse impact through any activity, although it must be borne in mind that many farming activities require
buildings which are best sited, in landscape terms, close to existing building groups in the rural landscape.'
a) the proposal is for the expansion of buildings currently used as a chicken farm b) a number of birds already visit their garden and damage their landscape; this could increase if more birds are kept on the site c) the proposal will detract property values d) concerned about increased vermin

This would not be in keeping with the surroundings d) There is no vehicular access to the site. Recommendation:
C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
The development hereby permitted shall not be carried out except in full accordance with the following plans: site location plan, details of shed received on 24 May 2013; revised block plan (showing existing trees) and details of entrance gate received on 08 July 2013.
C 3. The shed hereby approved shall not be used other than for purposes incidental to the agricultural use of the land.
N 1. The applicant is advised that there are overhead/underground power lines in the area and that they should contact the Manx Electricity Authority for further advice.
