THE APPLICATION IS BEFORE THE PLANNING COMMITTEE AS THE APPLICANT IS A MEMBER OF STAFF IN THE PLANNING AUTHORITY
1.0 THE APPLICATION SITE
1.1 The application site is the residential curtilage of 27 Birch Hill, a single storey detached bungalow sited on a corner plot on the western side of Birch Hill Crescent and southern side of Ivydene Avenue in Onchan.
1.2 The existing dwelling is finished in a pebble dash render with a pitched roof finished in interlocking concrete tiles. Birch Crescent and Ivydene Avenue is characterised by a mix of single storey properties of different form, layout and appearance.
1.0 THE PROPOSAL 1.1 This retrospective planning application seeks the approval for the removal of a central chimney stack. 1.2 The chimney stack was removed for safety reasons with the roof tiled over to match the existing. 2.0 PLANNING HISTORY
2.1 Planning permission was granted in 1992 for the demolition of existing garage & construction of kitchen and garage extension under PA 92/00039/B. Prior to this planning permission was granted under PA 87/04778/B for an extension to form extra bedrooms, alterations to bathroom and installation of new wc in 1988.
3.0 PLANNING POLICY
3.1 In terms of local plan policy, the application site is designated as Predominantly Residential under the Isle of Man Planning Scheme (Onchan Local Plan) Order 2000.
3.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application:

General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (1) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption."
4.1 At the time of writing there have been no written representations made regarding the current planning application.
5.1 Given the nature of the planning application it is imperative to consider the impacts of the removal of the chimney on the appearance of the main dwellinghouse and street scene of Birch Hill. 5.2 The chimney stack was removed during the course of repair work as it started to crumble under repair works. It was therefore determined that the complete removal of the chimney stack was a safer option. 5.3 The removal of the chimney stack is not judged to impact upon the enjoyment of the main dwellinghouse and cause a detriment impact to the appearance. The chimney stack was not judged to significantly contribute to the character and appearance of the property or the surrounding area in general. There is a mix of properties within the locality with a mix of designs, form and appearance. The removal of the chimney stack is not judged to have an adverse impact to the appearence of the locality. 5.4 Overall, it is concluded that the planning application is in accordance with General Policy 2 of the Isle of Man Strategic Plan 2007.
6.1 It is recommended that the planning application be permitted.
7.1 The local authority, Onchan District Commissioners, is by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d), considered "interested persons" and as such should be afforded party status.
