The Town and Country Planning (Development Procedure) Order 2005
On 9th April 2013, and in pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to REFUSE planning application 13/00240/A by Ms Dawn Mayor for the Approval in principle for the erection of a dwelling at Field Number 220364 Croit Miggal Dollagh Mooar Road Dollagh Ballaugh Isle Of Man for the following reason(s):
- The proposed development represents unwarranted development that is contrary to the land use designation of the application site under the Isle of Man Planning Scheme (Development Plan) Provisional Order 1982 and the presumption against the development of such areas set out within planning policies contained within the Isle of Man Strategic Plan 2007 that seek to protect the countryside from unsustainable and unwarranted development. Specifically, the proposal is contrary to provisions Strategic Policy 1, Strategic Policy 2, Strategic Policy 10, Spatial Policy 2, Spatial Policy 3, Spatial Policy 4, Spatial Policy 5, General Policy 3, Environment Policy 1 and Housing Policy 4 of the Isle of Man Strategic Plan 2007.
- It has not been demonstrated that acceptable levels of visibility could satisfactorily be provided for drivers of vehicles emerging from the site onto the public highway.

This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer's report which led to the decision (copy enclosed), together with correspondence relative to the application, are available for inspection at the Department.
If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
