I can advise that under the authority delegated by the Department to the Senior Planning Officer under Government Circular 09/09 (i), the Senior Planning Officer determined that the implementation of the submitted drawings (03 rev. A & 04) showing the construction details of the spillway and the accompanied letter from the Isle of Man Water and Sewerage Authority would satisfy Condition 3 of the above approval. Ballamona Mill, Old Castletown Road, Braddan. The Senior Planning Officer is requested to consider a submission made in relation to condition no 3 of the above approved planning application. Condition no. 3 states:"Prior to the commencement of development, construction details of the spillway must be submitted to and agreed in writing by the Planning Authority." The submission relating to the above condition comprises drawings (03 rev. A & 04) showing the construction details of the spillway and is accompanied by a letter from the Isle of Man Water and Sewerage Authority confirming that the details meet their requirements. As the condition was basically imposed at behest of the Isle of Man Water and Sewerage Authority it is concluded that their satisfaction serves to demonstrate that the submission suitably meets the requirements of condition no. 3.
