The proposal covered land to the rear of Orry Place, Stenning Place, King Williams Terrace, and Derby View on the Janets Corner Estate, Douglas Road, Castletown. The works involved clearing redundant structures — garages and a disused MEA substation — and creating a new landscaped open area in their place, along with rear and side boundary fences and a new pedestrian connection between two properties on Orry Place. The site sits within an area designated as Predominantly Residential under the Castletown Local Plan (1990), with General Policy 2 of the Isle of Man Strategic Plan also applicable. The decision notice identified the main planning issues as whether the scheme would be visually and practically acceptable to the local community. There was no relevant planning history. The application was determined under delegated powers and permitted.
The application was approved on the basis that the removal of redundant structures and their replacement with landscaping and improved pedestrian access was considered visually and practically acceptable within this predominantly residential area. No planning history raised concerns, and the proposal was consistent with the applicable local plan and strategic plan policies.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This permission relates to the replacement of the existing garages with planted public space, the erection of fencing and the creation and alteration of pedestrian footways, all as shown on Drawing Nos. 40, 41 Rev A, 42 Rev A and 102 Rev D (all received on 22 November 2012).
Condition 3
No development shall take place until full details of the proposed landscape planting and tree planting have been submitted to and approved in writing by the Planning Authority. These details shall include planting plans and schedules of plants, noting species, plant/tree sizes and proposed numbers/densities of plants.
Condition 4
All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following completion of the development. Any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased must be replaced in the next planting season with others of similar size and species.
