In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Infrastructure does hereby APPROVE the following application made on behalf of:

which was considered on 23rd September 2010, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This permission relates to the erection of a replacement dwelling, the conversion of two stone barns to provide guest/staff/tourist accommodation, the conversion of an outbuilding to form additional living accommodation to the proposed dwelling, and the erection of a portal framed store, Ballingan Farm, Braaid Road, Marown as shown by drawings WL/10/1151/1, WL/10/1151/2A, WL/1151/3A, WL/10/1151/5A, WL/10/1151/6, 6930/JEG/SAS, and the Justification Statement and Support letter all received 3rd June 2010.
- Prior to the occupation of the approved development, the existing dwelling must be demolished and the site must be landscaped in accordance with approved plan WL/10/1151/3A.
- All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the development, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
- Prior to the commencement of development, including demolition, a bat survey that covers buildings to be converted within the application site must be submitted to and agreed by the Planning Authority. Such survey must be prepared by appropriately qualified persons and include a schedule of any necessary mitigation measures required during the course of construction. Thereafter, any agreed mitigation measures must be undertaken during the course of construction.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

The proposed development must not be commenced until either;

Whichever is the later.
