The application site represents the curtilage of apartment 702, Kings Court Apartment Block on the Queens Promenade in Ramsey. This large apartment block is located to the west of Queens Promenade, south of St Pauls Church and runs parallel to the Queens Court apartments in Ramsey.
The application site is within an area of "Predominantly Residential Use" identified under the Ramsey South Local Plan, which was approved by Tynwald in 1998. The Isle of Man Strategic Plan 2007 contains one policy which is considered specifically material to the assessment of this current planning application - General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
There have been numerous separate planning applications for balcony enclosures which have been permitted over the years which should be considered relevant in the assessment and determination of this application.
Enclosure of balconies - 09/00238/B - APPROVED. This application was approved which allowed any balcony enclosure being fitted to any unenclosed balcony of Kings Court or fitted as a replacement to any balcony previously enclosed. Any other pattern or design of balcony enclosure (whether or not replacing a previous balcony enclosure) must form the subject of a separate detailed application.
The proposed application seeks approval for installation of a replacement balcony enclosure with white UPVC windows to the top windows and UPVC rosewood to the bottom windows.
This application does not come under the overall approval for balconies allowed under application 09/00238/B, as the windows openings differ.
The Authority has received no other privately written representations objecting to the application. ASSESSMENT The proposal would be replacing an existing enclosed balcony with one of a very similar design and finish, with the exception that the window frames would have a 50:50 split, instead of the existing 1 / 3 split at low level.
The proposal would be in keeping with the large apartment block, which a number of residents have benefited from very similar development.
For these reasons the proposal is considered acceptable and it is recommended that the planning application be permitted.
It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:
Ramsey Commissioners The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
