Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Housing Policy 6,
The application site is seeking and approval in principle for the erection of a dwelling. The development is compatible with the area since the area is zoned as predominantly residential in the Douglas Local Plan. It is considered the principle of developing the site for a residential use is acceptable within this locality.
The Highways Division do not oppose the application as there are not traffic managements, parking or road safety implications.
The site is adjacent to a river. The indicative plans show the approximate position of the dwelling. The dwelling would be approximately 37m away from the river. The reserved matters application needs to include full details of the finished floor level of the dwelling.
In terms of the impact on Stovell Lodge, there is an access road which runs past this property leading to Stovell. It is proposed the future occupiers of the dwelling would use the same access road. The proposal will certainly lead to an increase in volume of vehicles travelling past Stovell Lodge. This increase will be relatively small. It is considered the use of the access road by an additional dwelling will adversely affect the residential environment of Stovell Lodge.
RECOMMENDATION It is recommended that planning permission be granted subject to conditions. PARTY STATUS
The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Highways Division of the Department of Transport is now part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.
The Manx Electricity Authority has commented on non-planning matters and as such should not be afforded party status in this instance. Approval of the details of siting, design, external appearance of the building[s], internal layout, means of access, landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Planning Authority in writing before any development is commenced.
The application for approval of the reserved matters shall be made to the Planning Authority before the expiration of two years from the date of this permission.
The development to which this permission relates shall begin within 4 years of the date of this permission or within two years of the final approval of the reserved matters, whichever is the later.
C 4. This approval relates to the application site as defined by the red line on drawing no. 2/10/UR date stamped the 6th May 2010.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
