The application site relates to the mid-terraced residential property, 3 Church Street, Peel. The site is located towards the middle of the terrace and is on the eastern side of Church Street. The properties on this side of Church Street are served by a rear lane which runs from Derby Road to Christian Street.
This application seeks approval for the installation of replacement windows to the front and rear elevations and the erection of a single storey lean to extension to the rear elevation. The proposed replacement windows would be uPVC sliding sash.
The application site is located within an area identified as being mixed use by the Peel Local Plan and is also within the Peel Conservation Area. Within the Isle of Man Strategic Plan, the following policy is relevant in the assessment and determination of this application:
Environmental Policy 35, which states: ""Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
PLANNING HISTORY There have been no previous planning applications relating to this property.
REPRESENTATIONS Peel Town Commissioners do not object to this application. The Highways Division does not object to this application.
ASSESSMENT The proposed windows would replicate the central glazing vertical bar and method of opening of the existing windows which are original to the property. As such it is judged that the special features which contribute to the character and quality of the conservation area would be replicated so as to preserve the appearance of the conservation area.
The first and second floor levels of the rear elevation are visible from the service lane however this is not a main public thoroughfare. The proposed windows would nonetheless be appropriate and the proposed extension would not be appreciated by the public and would not adversely affect private amenity so as to warrant refusal.
RECOMMENDATION Permit.
PARTY STATUS It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:
Peel Town Commissioners The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
