Department Of Infrastructure ### Memorandum TO: Michael Gallagher, Director of Planning and Building Control FROM: Miss Jennifer Chance, Development Control Manager ### Ref: DATE: 5 June 2012 Discharge of Conditions attached to planning approval 10/00702/B Alterations, Erection of Extension to provide Sports/Multipurpose Hall with associated changing facilities, community room, classrooms and kitchen facilities and incorporation of permanent nursery provision, creation of parking and new access Victoria Road Primary School, Castletown. Details have been submitted to discharge conditions 2 and 6 of the planning approval. Condition 2: 'No development may commence until there has been approved by the Planning Authority a scheme of landscaping. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings (sic) whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size of species'. Details of a planting scheme have been submitted. Much of this shows ornamental planting that is of no real interest to the planning authority. What is of interest is how the boundary is treated. There is to be a substantial plant bed along the boundary with no 9 Elizabeth Rise which will help mitigate the impact of the new car parking area. To the rear of 10 Elizabeth Rise will be a bed simply of Buddleia Davidii. Initially this was not considered to be sufficient, but further correspondence with the architect indicates that there is already a planted boundary in this location and the Buddleia is proposed to enhance it. It was also queried as to why no planting was proposed along the side boundary of 10 Elizabeth Rise, but there is a 2 m high wall already in this location, similarly there is a 2 m high fence along the rear boundary of no 6 Pickard Close. Consequently the landscaping plan is considered to be acceptable and the first part of condition 2 has been met. The condition cannot be fully discharged until the planting has taken place. Condition 6. 'Prior to the re-location of the existing mobile class-room, there must be submitted to and approved by the Department details of mitigation measure to minimise the displacement of flood-water; the relocation must be undertaken in accordance with the approved details; the mobile class-room must be removed within one month of the proposed permanent accommodation being occupied.' The applicants are not proposing any mitigation measures to minimise the displacement of floodwater. Whilst the site is shown on the flood maps, this is at the lower part of the playground and the unit is raised above the playground level by a further 250mm. WSA have been contacted and have stated: 'WSA are satisfied that the proposed location and proposed FFL of 5.25 m Douglas 02 is above the predicted 1 in 200 year plus climate change tidal level of 4.8 m Douglas 02. The site is not within the fluvial 1 in 100 plus CC. As the flooding is tidal the displacement of any water is not a concern.' Consequently I believe the first part of this condition has also been met. The condition cannot be fully discharged until the permanent replacement accommodation is provided and the mobile unit dismantled. Signed. Jennifer Chance Development Control Manager Signed. Date.
