The site represents the curtilage of Whitestone Stores - a shop with living accommodation behind, situated on the western side of Main Road (A7) through Ballasalla between the Whitestone and Bridge Road roundabouts. The site has approval for the construction of a detached garage at the rear of the house/shop.
The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as Predominantly Residential. On the draft Southern Area Plan which was published on 23rd October, 2009 the site lies within an area of Mixed Use.
Planning permission was granted for alterations to the shop and conversion and extension of the existing barn to create living accommodation under PA 05/2001. Planning permission was granted for the erection of a garage with games room above under PA 05/0067. The applicant sought and was granted an extension of the PA 05/2001 until 9th December, 2010. The applicant now seeks to amend this approval.
Proposed now is a simplified version of the approved scheme, omitting the projecting glazed element of the conversion of the building to the rear of the shop, which is to be converted to living
accommodation. As the work has not yet commenced, it should be considered afresh, rather than as a modification to the approved scheme. The barn is presently linked to the shop but is used only as a store. Its conversion is proposed, installing a new door and window in the side elevation and a new window, patio doors and eaves level dormers in the front elevation which faces into the rear yard and new garage.
REPRESENTATIONS Department of Transport Highways and Traffic Division (now Department of Infrastructure) and Malew Parish Commissioners indicate that they do not oppose the application
ASSESSMENT The draft Area Plan designates the site as within an area of Mixed Use which is compatible with what is proposed here and there are no policies within the Strategic Plan which would result in what was proposed previously being now considered unacceptable. The scheme utilises an existing building and with less physical change than was previously proposed. The alterations to the front elevation result in quite significant change to the appearance of the existing building but not with any detrimental impact.
As such, the proposal is considered acceptable.
PARTY STATUS The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
