THIS APPLICATION IS REFERRED TO THE PLANNING COMMITTEE AS THERE IS AN OBJECTION FROM HIGHWAYS AND TRAFFIC AND THE APPLICATION IS RECOMMENDED FOR APPROVAL.
The site represents the curtilage of an existing plot situated on the corner of the main road through Balthane Industrial Estate and a minor road leading to the north east. To the north west lies Manx Metals - a re-cycling operation. The site accommodates an industrial building with parking and manoeuvring space to the south west and north west.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Existing Industrial use. On the draft Southern Area Plan published on 23rd October, 2009 the site is identified as Industry and within a hazard zone relating to the gas storage tanks (buried) within the industrial estate. Environment Policy 29 of the Strategic Plan states that "In considering development proposals within Consultation Zones as designated on the Area Plans or
published Consultation Zone Maps, the Department will consult with the Health and Safety at Work Inspectorate to determine the appropriateness of the development. In all cases, the health and safety of the public will be the over-riding consideration. Developments which would conflict with the requirements of health and safety will not be permitted".

Status Permitted PA 94/00960/B - Siting of portakabin adjacent to warehouse, Manx Airlines, Balthane Road, Ballasalla, Malew. Status - Permitted PA 05/01968/B Installation of two new uPVC windows, one to the side elevation and the other to the eastern elevation Status Permitted Conditions
Proposed is the change of use of the premises from a warehouse to the manufacture of stone products - granite worktops, cills, signs, fireplaces and the like. The existing storage facilities on the ground floor will be used for production with a small display area to one side, 11.5 m by 5.5 m with a corresponding office area above which is existing. There are four spaces shown on the submitted plans, the Strategic Plan requires one space per 50 Sq . m of industrial floor space which would result in a demand for 8 parking spaces.
The applicant has submitted further plans which show nine parking spaces with room for vehicular manoeuvring. The width of some of the spaces is limited and only eight spaces may be provided on the ground. The applicant has confirmed that between 5 and 6 people work at the site at any one time depending upon the operation which involves delivery of mineral from the quarry.
Department of Transport Highways and Traffic Division (now Department of Infrastructure) object as the additional car parking spaces required by the Strategic Plan are not shown on the submitted drawings.
Malew Parish Commissioners indicate that they do not object to the application
Department of Transport Drainage Division (now the Water and Sewerage Authority) recommend a condition regarding sewerage legislation which is not a material planning concern
The proposed use is consistent with the land use designation and where, within the south there is a suggestion that Balthane is a more appropriate location for manufacturing and heavier types of industrial use than other estates such as Ronaldsway. As such the proposed use is acceptable in principle.
There is an increased requirement for car parking spaces as a result of the proposed change of use storage requires only one space per 100 sq. m of space whereas general industry is one space per 50 sq m of space. This requirement is now being satisfied by the submitted plans.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
The Water and Sewerage Authority are a statutory authority but raise issues which are not material consideration and should not be afforded party status in this instance

C 2 . This permission relates to the change of use of the existing site to the manufacture of stone products, as shown in drawing 447-02a received on 30th March, 2010 and the location plams reeived on 16th October, 2009.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
