THE SITE The site represents the curtilage of the Rushen Abbey Hotel, a former public house which has been taken over by Manx National Heritage and has recently been refurbished for use partly in association with the Rushen Abbey site to the south which is now an interpretative centre for the former monastery and burial sites within the grounds.
The Rushen Abbey Hotel is a free standing building with an area of hard standing directly in front, used for car parking to the hotel and the Rushen Abbey site. At the rear of the building there is an enclosed courtyard/garden, none of which is visible from the public road alongside.
PLANNING STATUS The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as High Landscape Value and Scenic Significance. On the draft Southern Area Plan which was published on 23rd October, 2009 the site lies within an area of Residential use.

Now proposed is the construction of a sun room on the rear elevation on an existing raised patio area. The conservatory will be fitted with timber framed sliding sash windows and have a roughcast rendered base wall an artificially slated roof.
Malew Parish Commissioners indicate that they do not oppose the application Department of Transport Drainage Division request a condition regarding the disposal of surface water. The proposal does not result in an increase in the paved area but the condition should be attached in case there is any change in the means of disposal of surface water
The site, building and surroundings are of historical importance and the property has recently been the subject of renovation and refurbishment works which are restoring the original character of the building.
The proposed works are at the rear of the building and will not be publicly visible other than to those who are patronising the building. However, the design and finish of the proposed sun room is authentic to the structure to which it is to be attached and as such would not be unacceptable even it were visible as part of the wider environment.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a sun room as shown in drawings K212/P-10-01, K212/P-10-02 and K212/P-10-03 all received on 12th February, 2010.
C 3. There must be no discharge of surface water to the main foul sewer.
