THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a detached dwelling that is located on Pinfold Hill in Lonan. The proposed development comprises the alteration and erection of extensions onto the dwelling. PLANNING HISTORY
Whilst the application site has been the subject of a previous planning application it is considered that this is not specifically material to the assessment of this current planning application.
REPRESENTATIONS Lonan Parish Commissioners recommend that the planning application be approved. The Department of Transport Highways Division do not oppose the planning application. The Department of Transport Drainage Division do not oppose the planning application.
The owners and/or occupants of Calder, which is located opposite the application site, express an interest in the planning application and highlight concern that the proposed extension may impact on the view from their property.
In terms of local plan policy, the application site is within an area recognised as being within predominantly residential use under the Laxey and Lonan Area Plan Order 2005. Policy L/RES/PR/1 states: "Residential development will generally only be approved within the study area in those areas designated as proposed and existing residential. In particular, in the case of Agneash no further dwellings will be approved although, as will be the case in areas zoned as residential, alterations and extensions to existing property may be accepted if such proposals are sympathetic to the character and appearance of both the building to be altered and the surrounding area in general."
In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application. General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Paragraph 8.12.1 of the Isle of Man Strategic Plan 2007 states "As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general.".
The planning application seeks planning approval for the alteration and erection of extensions onto the dwelling, with the proposed development comprising two single-storey flat-roof extensions on either end of the dwelling.
As the dwelling is set down from the road that serves it and is mostly screened by an existing roadside garage it has limited presence in the overall street scene. It is considered that the proposed extensions will therefore have suitably limited impact on public and private amenity. There is no impact on highway safety arising from the proposed development. As such, the proposal accords with policy L/RES/PR/1 of the Laxey and Lonan Area Plan Order 2005 and General Policy 2 of the Isle of Man Strategic Plan 2007.
As regards the concerns of the Calder it needs to be borne in mind that there is no automatic right to a view in terms of material planning considerations. Irrespective of that, in this instance, it is unlikely that the proposal would have any significant impact on Calder given that the level of development is relatively modest and single storey.
It is recommended that the planning application be approved.
