1.1 The above application was permitted on 7th August, 2014, subject to a number of conditions, one of which stated the following:
Condition 2: “Prior to the permanent depositing of any excavated material, further information on existing and proposed levels in the affected areas must be approved by the Planning Authority and the works carried out in accordance with these details.
Reason: to control the unauthorised control of tipping in the countryside.” 1.2 It was also required that “No material from the proposed excavation may be removed from the site. REASON: to protect the appearance and amenities of the countryside.” (condition 4)
Proposal
2.1 The applicant has submitted an unreferenced plan which bears the date 08.09.14. This shows existing levels in an area to the side of the existing barn. It is proposed to increase the level of this area by 500mm with the material excavated from the site for the barn approved in this application. It is likely that these figures are not precise and the area to be filled does not quite equate to an area which will result in an even spread of 500mm across the area and as the existing area is not level, it is not likely that the tipped material will result in a level area if applied consistently at a depth of 500mm.
2.2 However, it is a guide to the likely impact of what is proposed and where and bearing in mind the location of the area to receive the tipped material and its current appearance and the benefits of having the newly levelled area, it is considered that the proposed information satisfies conditions 2 and 4 and the purposes these were to achieve.
Recommendation
3.1 It is considered that the proposal satisfies condition for which the further information is required.
