I refer to the recent appeal in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) (No 2) Order 2013, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.
The Minister, the Hon P A Gawne MHK, has considered the report, concurs with the appointed person’s conclusions, and accepts the recommendation that the appeal should be allowed. Accordingly, he has directed that the Planning Committee’s refusal of the application under Article 6 of the Town and Country Planning (Development Procedure) (No 2) Order 2013 should be reversed, and that the application should be Approved subject to conditions. Formal notice of this decision is attached.

In pursuance of his powers under the above Act and Order, the Minister for Infrastructure, the Hon P A Gawne MHK, does hereby in the name of and on behalf of the Department APPROVE planning application 14/00687/A by Gerald Daniel Horisk for Approval in principle for erection of a dwelling at Land adjacent to Kella Sheear, Kella Road, Sulby, subject to the following conditions:
- The development hereby approved shall be begun either before the expiration of four years from the date of this approval or before the expiration of two years from the date of approval of the last of the reserved matters.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013.
- Application for the approval of the reserved matters shall be made to the Planning Authority before the expiration of two years from the date of this approval and thereafter the development shall only be carried out in accordance with the details as approved.
Reason: To avoid the accumulation of unimplemented planning approvals.
- Prior to any works commencing on site the access and visibility delays of 2m x 18m in each direction shall be constructed in accordance with a drawing approved by the Department and retained free from construction thereafter.
Reason: In the interests of highway safety. Note: This approval relates to the location plan Ref No-1 received by the Planning and Building Control Division on 2 June 2014. Date of issue: 14 January 2015
