Department Of Infrastructure ### Memorandum To: Jennifer Chance, Development Control Manager From: Edmond Riley, Assistant Planning Officer Subject: Condition Discharge Date: 3rd November 2014 --- Re: Outbuildings, Claddagh Farm, Sulby Bridge, Sulby The following condition (Condition 3) was attached to the approval notice: > "Prior to the commencement of any works, details, including elevations of the means of providing the required visibility splays, must be submitted to and approved in writing by the Planning Authority. > "Reason: in the interests of highway safety and the visual amenity of the area." Concern was raised during the application’s discussion at Planning Committee with respect to the visibility afforded to the access onto the highway from the application site. Highway Services did request visibility splays of 2.4m x 90m in each direction be provided in each direction in their original representation to the planning application. However, in the event, the condition was worded less specifically, and referred solely to “required visibility splays”. This has been fortunate from the applicants’ point of view as it has since become clear that visibility splays of 2.4m x 90m in each direction could not be provided as the splay would be on land outwith their control and which the adjacent landowner has not given their permission to cut the vegetation within. Discussions have taken place between the applicant and Highway Services that Planning have not been party to. The applicant has provided a covering letter indicating the likely usage of the access for their purposes and also a record of all accidents on the highway between their site and the Ginger Hall Hotel to the south for the previous 20 years. Also provided to both Highway Services and Planning is a drawing showing what level of visibility can be obtained. Highway Services have, in light of the discussions held with, and the information provided by, the applicant, indicated that they are content to allow the condition be discharged. This in itself is considered sufficient to conclude that the “required visibility splays” can be provided, albeit that they would not be of a size that might normally be expected (or, indeed, what was initially requested by Highway Services). It is therefore recommended that the condition be discharged. Hard copies of all the correspondence, plan and information referred to in the paragraphs above are attached to this Memorandum.
